PROTECTING THE LEGAL POSITIONS OF INDIVIDUALS TO LIMIT THE ARBITRARINESS OF THE ADMINISTRATIVE AUTHORITY
The legal recognition of the administration’s right to take measures and issue administrative decisions that affect the legal positions of individuals, whether cancellation, modification or creation is restricted by the principle of administrative legality and adherence to the law, and the administrative decision requires that it be issued with some controls and restrictions that stand in the face of any abuse of authority, and in the form that it specified The law is based on an existing and valid reason, and despite that, we find that the administration sometimes may deviate from the scope of legality, and as a result of these attacks that individuals may be exposed to, there is no way to guarantee their rights except through the administrative lawsuit “ an appeal for misuse ” which forms the basis that protects administrative legality Or a "claim for compensation" due to the arbitrariness of the administration.
