RESTORATIVE JUSTICE: A NEW PARADIGM FOR CRIMINAL JUSTICE?

The state´s monopoly on the power of punishment led to the failure of punitive justice to put an end to the criminal phenomenon, these conditions prompted thinkers and those in charge of criminal and penal policy to search for solutions to this phenomenon, In recent years, restorative justice has emerged, which has formed an important topic in the development of criminal justice and which is intended to involve the parties to crime and civil society in the effective and collective participation in addressing and solving the problems arising from the crime. Undoubtedly, the agreement and restorative values will promote punitive justice and contribute to its side in combating the phenomenon of crime by granting the conflict parties a positive role in the conduct of their issue.
